Scope

For all orders placed through our online shop, the following Terms and Conditions apply. Our online shop is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.

2. Contractual Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with Motorcycle Service Lage GmbH.

The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding invitation to submit an offer (invitatio ad offerendum). You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive another confirmation by email.

3. Contract Language, Storage of Contract Text

The language available for the conclusion of the contract is German.

We store the contract text and send you the order data and our Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the internet.

4. Delivery Conditions

In addition to the stated product prices, shipping costs are added. You can find more details about the shipping costs in the offers.

We do not deliver to packing stations.

5. Payment

In our shop, the following payment methods are generally available to you:

PayPal

During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or first register, authenticate with your access data, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately afterward. You will receive further instructions during the ordering process.

PayPal Plus

As part of the PayPal Plus payment service, we offer you various payment methods as PayPal Services. You will be redirected to the website of the online provider PayPal. There you can enter your payment data, confirm the use of your data by PayPal, and the payment instruction to PayPal.

If you have chosen the PayPal payment method, you must be registered there or first register and authenticate with your access data to pay the invoice amount. The payment transaction is carried out automatically by PayPal immediately after confirming the payment instruction. You will receive further instructions during the ordering process.

If you have chosen the credit card payment method, you do not need to be registered with PayPal to pay the invoice amount. The payment transaction is carried out immediately after confirming the payment instruction and your authentication as the legitimate cardholder by your credit card company at the request of PayPal, and your card is charged. You will receive further instructions during the ordering process.

If you have chosen the invoice payment method, you do not need to be registered with PayPal to pay the invoice amount. After a successful address and credit check and submission of the order, we assign our claim to PayPal. In this case, you can only make payments to PayPal with debt-discharging effect. For the payment processing via PayPal, the PayPal Terms and Conditions and the PayPal Privacy Policy apply in addition to our Terms and Conditions. Further information and the complete PayPal Terms and Conditions for invoice purchase can be found here.

If you select a payment method offered via the payment service "Mollie," the payment processing is carried out via the payment service provider Mollie B.V., Keizersgracht 313, 1016 EE Amsterdam, Netherlands (hereinafter: "Mollie"). The individual payment methods offered via Mollie are communicated to the customer in the seller's online shop. To process payments, Mollie may use other payment services for which special payment conditions may apply, to which the customer may be separately informed. Further information about "Mollie" can be found on the internet at https://www.mollie.com/de/ .

6. Retention of Title

The goods remain our property until full payment has been made.

7. Transport Damage

If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, particularly your warranty rights. However, they help us to assert our own claims against the carrier or transport insurance.

8. Warranty and Guarantees

The statutory liability for defects applies. Information on any additional warranties that may apply and their exact conditions can be found with the product and on special information pages in the online shop.

9. Liability

We are always fully liable for claims due to damages caused by us, our legal representatives, or agents

• in case of injury to life, body, or health

• in case of intentional or grossly negligent breach of duty

• in case of guarantee promises, if agreed, or

• as far as the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the contractual partner may regularly rely (cardinal obligations), due to slight negligence by us, our legal representatives, or agents, the liability is limited to the amount of the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected.

Otherwise, claims for damages are excluded.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/. Consumers have the opportunity to use this platform to resolve their disputes.

To resolve disputes arising from a contractual relationship with a consumer or about whether such a contractual relationship exists at all, we are obliged to participate in dispute resolution proceedings before a consumer arbitration board. The responsible body is the General Consumer Arbitration Board of the Center for Arbitration e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. We will participate in a dispute resolution procedure before this body.

11. Spare parts may only be installed by qualified and instructed specialist personnel (specialist workshop). Proof of this can be the invoice from the specialist workshop. Improper repair may compromise the proper functioning and safety of the component. We are not liable for damages resulting from improper installation by third parties. If there are additional country-specific requirements and regulations, they must be observed.
